Terms of Service

01. Contractual Acknowledgment

By interacting with the digital infrastructure, proprietary interfaces, or service modules of The Doctor [dot] Earth, you hereby signify your irrevocable acceptance of these Terms of Service. This document constitutes a legally binding covenant between the user and the platform administration.

02. Intellectual Property Preservation

All compositions, sonic textures, visual motifs, and source codes hosted on this platform are the exclusive intellectual property of The Doctor [dot] Earth. Unauthorized reproduction, distribution, or commercial exploitation of these assets is strictly prohibited under international copyright statutes.

03. Professional Service Engagement

Engagement in musical production, mixing, or mastering services constitutes a professional work-for-hire agreement. The client acknowledges that creative labor is non-refundable and that the final aesthetic outcome is subject to the professional discretion of our engineering staff.

04. Digital Asset Finality

Due to the non-tangible and irrevocable nature of digital goods (including sample libraries, MIDI sequences, and digital audio files), all transactions are deemed absolute upon the initiation of the download sequence. No restitution or exchanges are permitted for digital software assets.

05. Financial Integrity & Encryption

We utilize Tier-1 SSL (Secure Sockets Layer) encryption to facilitate all financial data exchanges. By processing a payment, you warrant that you are the authorized custodian of the financial instrument used and that all transaction data provided is accurate and verifiable.

06. Logistics & Shipping Indemnification

The Doctor [dot] Earth is not liable for any physical products damaged, compromised, or lost during the shipping process. Title and risk of loss for all physical merchandise transfer to the consumer upon our delivery of the item to the logistics carrier.

07. Media Replacement Disclaimer

Defective or damaged media—including but not limited to Vinyl records, Compact Discs, and Apparel—will not be replaced or refunded. Consumers assume all responsibility for the condition of physical goods post-dispatch.

08. Revisionary Limitations

Our standard production protocol allows for a maximum of three (3) iterative revisions. Any subsequent modifications requested beyond this threshold will be classified as "Extended Consultation" and will incur additional billable hours at our current professional rate.

09. Prohibited AI & Machine Learning Exploitation

The use of any sonic assets from this platform for the training of Large Language Models (LLMs), generative AI vocal synthesis, or machine learning algorithms is strictly forbidden without a specifically negotiated "AI-Exploitation License" signed by our legal department.

10. Account Security & User Liability

Users are mandated to maintain the strict confidentiality of their account credentials. Any unauthorized access resulting from user negligence or password compromise is the exclusive liability of the account holder, and not The Doctor [dot] Earth.

11. Jurisdictional Governance

These terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which The Doctor [dot] Earth is registered. Any legal disputes arising from these terms shall be settled in the courts of said jurisdiction.

12. Third-Party Externalities

Our platform may contain links to external streaming services or financial gateways. We hold no responsibility for the content, privacy policies, or operational integrity of these third-party entities.

13. Infrastructure Maintenance & Uptime

While we strive for 99.9% system availability, we do not guarantee uninterrupted access. Periodic maintenance is required to ensure the security and performance of our musical distribution servers.

14. Modification of Global Protocols

The Doctor [dot] Earth reserves the right to amend, modify, or replace these Terms of Service at its sole discretion. Continued engagement with our services following such updates constitutes your acceptance of the new protocols.

15. Force Majeure Clause

We are excused from performance obligations under these terms in the event of unforeseen circumstances beyond our control, including natural disasters, global pandemics, telecommunication collapses, or civil unrest.

16. User Data Privacy

Your personal information is governed by our dedicated Privacy Policy. We collect only the data necessary to facilitate high-quality service delivery and secure financial processing.

17. Project Abandonment Policy

Studio projects left inactive for more than 45 days due to client non-communication will be officially archived. Restoration of archived projects may be subject to a "Database Recovery Fee."

18. Prohibited Content

Users are forbidden from providing audio stems or visual materials that contain hate speech, promote illegal activities, or infringe upon the intellectual property rights of third parties.

19. Indemnification Covenant

You agree to indemnify and hold harmless The Doctor [dot] Earth and its affiliates from any legal claims, damages, or expenses arising from your violation of these terms or misuse of our digital assets.

20. Severability Clause

If any provision of these Terms is determined to be unlawful, void, or unenforceable by a court of law, such provision shall be deemed severable, and the remaining provisions shall continue in full legal effect.

21. Entirety of Agreement

This document constitutes the final and complete agreement between the User and The Doctor [dot] Earth, superseding all prior oral or written communications, negotiations, or proposals.
